1. Agreement to Terms

By accessing or using VibeArt ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Service Access and Restrictions

We grant you a limited, non-exclusive, non-transferable right to access and use the VibeArt service for your creative and commercial projects, subject to an active subscription and available credits.

You may not:

  • Resell, sublicense, or provide access to the Service without our written permission
  • Use the Service to build or operate a competing AI creation platform
  • Attempt to reverse engineer, scrape, or abuse the Service infrastructure
  • Remove proprietary notices or misrepresent VibeArt content as your own
  • Use the Service in any way that violates applicable laws
3. User Accounts

When you create an account with us, you must provide accurate information.

You are responsible for:

  • Maintaining the security of your account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

We reserve the right to terminate accounts that violate these Terms or are inactive for extended periods.

4. Payments, Access, and Refunds

Subscriptions

Paid plans are billed on a recurring basis (monthly or annual) until canceled. Your plan determines how many credits you receive each billing period.

Credit Packs

You may also purchase one-time credit packs to top up your balance. Credit packs are delivered immediately upon successful payment.

We offer a layered refund policy designed to be fair to both customers and our service:

Price Changes and Discounts

Prices and discounts may change over time. Any changes do not affect past purchases.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful code or malware
  • Engage in unauthorized access or hacking
  • Harass, abuse, or harm others
  • Spam or send unsolicited communications
  • Impersonate others or misrepresent your affiliation

Content Generation Policy

When using our AI generation features, you are strictly prohibited from creating, generating, or attempting to generate:

  • Pornographic, sexually explicit, or adult content of any kind
  • Content depicting real individuals without their consent (deepfakes, unauthorized likenesses)
  • Content that infringes copyrights, trademarks, or other intellectual property rights (including reproducing copyrighted characters, logos, or brand imagery)
  • Violent, gory, or excessively disturbing imagery
  • Content promoting hate speech, discrimination, or harm against individuals or groups
  • Content depicting child exploitation or abuse in any form
  • Misinformation, disinformation, or deceptive content intended to mislead
  • Content that facilitates illegal activities or promotes harmful behavior

Violation of this content policy may result in immediate account termination without refund, and we reserve the right to report illegal content to appropriate authorities. We employ automated and manual review systems to detect policy violations.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by VibeArt and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you create using the Service. By using the Service, you grant us a license to use, store, and display your content as necessary to provide the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBEART SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. IN ALL CASES, OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID TO VIBEART IN THE PRIOR 12 MONTHS.

9. Indemnification

You agree to indemnify and hold harmless VibeArt from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that should survive termination shall survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

As we operate globally, we comply with applicable consumer protection laws in your jurisdiction. If you are a consumer in the European Union, United Kingdom, or other regions with mandatory consumer protection laws, you retain the rights granted to you under such laws, and nothing in these Terms shall limit those statutory rights.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes. Your continued use of the Service after changes constitutes acceptance of the new Terms.
